The Supreme Court of the Russian Federation has accepted for consideration the cassation appeal of the Federal State Unitary Enterprise Krylov State Research Center against the decision to collect a penalty in the amount of 90 million rubles in favor of JSC Baltic Shipyard. As follows from the court’s ruling, a contract was concluded between the enterprises for the supply of electric propulsion systems for icebreakers.
According to the terms of the contract concluded in January 2022, the equipment was to be delivered by the research center by May 31, 2022, but the actual delivery was completed only in August 2023. Baltic Shipyard considered the delay a violation of obligations and demanded that the supplier collect over 600 million rubles in penalties and fines. The Arbitration Court of St. Petersburg partially satisfied the claims, determining to collect about 90 million rubles in penalties and a fine of 700,000 rubles for an incomplete set of documents.
