In August, several foreign companies asked Russian courts to transfer their disputes to Russia under Article 248.1 of the Commercial Procedure Code, notwithstanding existing arbitration clauses. In two instances, this was permitted – a departure from previous practice, where courts had primarily used this provision to protect Russian companies. Legal professionals view this as a new trend in the application of the “Lugovoy Law.” Another relatively new trend is the use of anti-suit injunctions in family law disputes; such practices are emerging in both Russia and the UK amidst the dispute between Natalia and Vladimir Potanin. Additionally, the US Department of Justice has supported Russia’s position in the dispute with Naftogaz, while VK has filed a lawsuit against Apple in the Moscow Commercial Court.
