We analysed the possibility of legally operating the rented building which the landlord was repairing. The landlord at first treated the work as reconstruction and obtained all the necessary permits (in particular, the building permit). The landlord was then unable to commission the reconstructed building and asked the client to operate it without commissioning, arguing that the work was not reconstruction in the legal sense and did not require a commissioning permit. However, operating a building without a commissioning permit, when such a permit is required, entails fines and the suspension of activities. We analysed this issue for our client and provided recommendations on the legal nature of the work performed and what steps should be taken to continue to use the rented building without incurring administrative responsibility.
