International Digest for September: The “Lugovoy Law” as Applied to Arbitration in Moscow, and Interpreting Rulings in One’s Own Favor / Comment / Pravo.ru

In September, the body of case law concerning the “Lugovoy Law” (Article 248.1 of the Arbitration Procedural Code of the Russian Federation) expanded to include new matters. Notable among these is the case involving the Austrian company Bowas-Induplan Chemie, where Article 248.1 was applied to an ICC arbitration seated in Moscow. Legal experts view the court’s conclusion as logical, noting that the parties’ requirements for an arbitrator would likely have precluded the selection of a candidate who would not have applied EU sanctions regulations. Meanwhile, in Singapore, a court upheld a victory for a Russian company; a domestic investor filed a claim against Uzbekistan; and, in a dispute with EuroChem, Maire breached the confidentiality of an arbitral award by interpreting it in its own favor.
