Providing legal support in structuring the sales and operation of non-residential premises in a building that is a federal cultural heritage site

We are providing legal support in structuring the sales and operation of luxury apartments (non-residential premises) in a building that is a federal cultural heritage site. The apartments will be managed by an international hotel operator; the specificity of the project is that the apartments will be used exclusively for living, and not for the provision of hotel services. For our client, we have developed draft contracts for the sale and booking of apartments, drafts of internal documents of a real estate partnership that will be created in the building, draft policies for the operation of apartments and other documents. The project is unique for Russia, as a hotel and privately owned apartments (which are quasi-housing) operated by an international hotel operator will be located in one monument building. Considering this, a legal structure needs to be developed in which the owners’ operation of their apartments will be regulated according to the international hotel operator’s standards, and to ensure that the apartments are used exclusively for living. The current legislation on apartments is undergoing reform and currently does not allow to directly achieve this goal. Therefore, we are developing non-standard, exclusive and complex legal solutions for our client to meet its objectives.
