Time limits for registering inventions may increase

The deadline for filing applications for the registration of an invention that has already been demonstrated at exhibitions or whose information has already been published in scientific journals is planned to be extended from six months to a year. These amendments to the Civil Code by the Ministry of Economic Development have been approved by the government. As explained by Rospatent, the changes will help authors who have already shown their developments somewhere or talked about them, but have not yet applied for a patent: the extension of the deadlines will ensure their applications meet the “novelty” criterion.

Vera Zotova Ph.D., Senior Associate in the Intellectual Property and Information Technologies Practice at Nordic Star Law Offices noted in an article for “Izvestia.ru” that the need for changing the deadline is also related to the widespread use of social networks and the overall speed of information dissemination in the modern world.

The comment is available on the “Izvestia.ru” website.
