Russian court sends Russian plaintiff to England for justice
Kommersant has uncovered a rare case in which a Russian court refused to recognise its jurisdiction over a case involving Russian legal entities and sent them to the “unfriendly” UK for trial. The reason for this was the terms of the agreements between the parties to the dispute, which contained a clause on the jurisdiction of a foreign court. Lawyers interviewed by Kommersant noted that such an approach is uncharacteristic of Russian practice after February 2022. The question remains, however, whether the British court’s decision will then be recognised in Russia.
Nordic Star Law Offices Senior Partner Andrei Gusev commented on the case in an article for Kommersant.
